By accessing this Site, you agree to be bound by these Terms of Use. If you do not agree with any of these terms, you are prohibited from using this Site.
1. Site Status and Intellectual Property            1.1. SHMUPRADIO operates as an information intermediary. All musical content (audio recordings, compositions) is streamed as part of the Site’s non-commercial, community-driven activities. The Site Administration does not perform pre-moderation or censorship of the streamed content.
            1.2. All intellectual property (including but not limited to musical compositions, sound recordings, track names, and album art) featured on the Site is the property of their respective legal rights holders (composers, performers, record labels, and game companies). SHMUPRADIO does not claim and does not acknowledge any rights to this third-party content.
            1.3. Materials pertaining to the Site itself (design, logo, text content) are protected by copyright and trademark law and are the property of the Site Administration.
2. Acceptable Use of the SiteYou are granted a limited, non-transferable license to access the Site and for personal, non-commercial listening of the streamed audio. Under this license, you may not:
Extract, copy, modify, or republish any audio content from the Site.
Use the Site’s materials for any commercial purpose.
Attempt to circumvent any technical protections measures on the Site.
Post any content to the Site that infringes on the rights of third parties.
The Administration reserves the right to terminate your access upon any violation of these restrictions.
3. Disclaimer and Limitation of Liability            3.1. All materials on the SHMUPRADIO website are provided “as is.” SHMUPRADIO makes no warranties, expressed or implied, and hereby disclaims all other warranties to the fullest extent permitted by law.
            3.2. In no event shall SHMUPRADIO or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption, or broadcast failure) arising out of the use or inability to use the materials on the Site, even if the Administration or an authorized representative has been notified orally or in writing of the possibility of such damage.
4. Copyright Policy and Takedown Procedure            4.1. The Administration of SHMUPRADIO recognizes the complex nature of copyright in the digital age and is committed to constructive dialogue with rights holders. We believe our non-commercial activity promotes cultural exchange and increases interest in original soundtracks.
            4.2. Procedure for Submitting a Copyright Takedown Notice.

            If you are a rights holder or an authorized agent and believe that any material on the Site infringes your exclusive rights, please submit a formal takedown notice.
To be valid, your notice MUST include all of the following information:
Your Contact Information: Full name (or company name), physical address, email address, and telephone number.
Proof of Rights: Evidence of your ownership of the work (e.g., a link to a registration, a certificate) or documentation confirming your authority to act on behalf of the rights holder.
Identification of the Infringing Material: Precise name of the track/composition and the specific URL(s) on the Site where it is accessible.
Required Statements: The following statements must be included in the body of your notice:
“I have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.”
“The information in this notification is accurate. I acknowledge the liability for perjury in the case of a false claim.”
“I am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.”

Your Signature: An electronic or physical signature of the authorized person.
            4.3. Valid notices that substantially comply with all requirements in section 4.2 will be processed as a priority. The Administration undertakes to remove or disable access to the allegedly infringing material in the shortest technically feasible time.
            4.4. Send all notices of copyright infringement EXCLUSIVELY to the designated email address: tell@shmupradio.com

            Notices sent to other channels may not be processed.
5. Miscellaneous            5.1. The Site may contain links to third-party websites. SHMUPRADIO is not responsible for the content of these linked sites and your use of them is at your own risk.
            5.2. The Administration reserves the right to revise these Terms of Use at any time without notice. The current version will always be posted on this page. By continuing to use the Site after revisions are posted, you agree to be bound by the updated version.
            5.3. These Terms of Use and any disputes related to the Site shall be governed by the laws of the Russian Federation.
